It’s the End of a Due Process Clause as We Know It!

I am no Constitutional Scholar, but if something is mentioned in the Constitution twice (in the 5th and the 14th Amendment), it must be important. I am referring to a Due Process Clause:
No person..shall be deprived of life, liberty, or property without due process of the law
Or
…no shall any State deprive any person, liberty, or property without due process of the law.
Pretty clear. Now let’s get to the matter at hand, - the attorney representing the government submits a declaration of some FBI official (who doesn’t write laws, but only executes them) that any US citizen can be put on the “Selectee” list of the Terrorist database if they meet reasonable suspicion standard applicable to known and suspected terrorists AND also satisfy additional specific criteria (which are not public for security reason).
This is a poorly hidden attempt to confuse citizens and camouflage a totally unconstitutional process as law. And who is making these statements? A newly promoted FBI Acting Director of the Terrorist Database who has no place creating laws!

The deadline for the defendants’ reply was May 1st. The person providing this Declaration, Samuel Robinson, became Acting Director of Operation of the Terrorist Screening Center on May 1st, 2023. On May 2nd, Robinson signed said declaration.

I still believe in the Constitution. I believe that the rule of law can be restored, if we put the FBI in its place, fix It, and stop letting them invent secret rules they have no business creating. Call me an optimist.

Thanks for your informed response,from the inside out! How terrible it is to know you cannot go anywhere in the world and you are at the mercy of this horrific program. So many TIs try to move away or stay on the run hoping for safety but it often only gets worse. I believe this started with the CIA with Operation Paperclip and then MKUltra, which was never discontinued in spite of name changes. But all the intelligence agencies are interconnected. The FBI has gotten progressively out of control. In 2021 they conducted 3.4 warrant less searches as reported by a Congressional Hearing on Justice in advance of a forthcoming review of FISA program and even the FISA Court has expressed concern. This hearing took place on 4-28-23 and is in the Electronic Frontier Foundation blog about this PCLOB committee on these (702) Reforms which EFF considers inadequate. This is important because none of this could happen without heavy ongoing surveillance. I try to be hopeful because we have more proof now! The acceptance of the Havana Syndrome as medical documentation; pinpointing the cause of this as pulsed microwaves and getting a prestigious journal to print the article makes it a scientific fact even if the Intel community tries to say otherwise; Biden made Signals Intelligence illegal and those can be measured, and I am only now learning that the Common Law is important. We are putting the pieces of a puzzle together and we now have most of them. So please don’t lose hope! I do want to say that different TIs mean different things by V2K, ranging from extreme tinnitus to synthetic telepathy, to audible speech of various ppl talking about TI, to direct communication as if on a phone call. They try to instill fear, confuse and distract. But I truly believe we will get there!
